These Terms of Service (“Terms”) govern your access to and use of the services offered by GlobalMark LLC (“GlobalMark,” “we,” “us,” or “our”), including our website, platform, and related services (collectively, the “Services”).
 

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
 

1. Use of Services

GlobalMark provides recruiting services that connect job seekers (“Candidates”) with companies (“Clients”) and occasionally with third-party recruiting partners. You may use the Services only for lawful purposes and in compliance with all applicable laws and regulations.
 

You agree not to:

  • Misrepresent your identity, experience, or credentials

  • Submit inaccurate, misleading, or inappropriate content

  • Use automated means to access the Services without permission

  • Reverse engineer, copy, or interfere with the operation of the Services
     

2. Resume Submissions

Some areas of the Services may require you to submit personal information, such as a resume or job application. You agree to provide accurate and current information. While we do not offer user accounts for Candidates, you are responsible for ensuring that the information you submit is truthful, lawful, and up to date.

Submitting a resume does not guarantee job placement, interview opportunities, or any employment outcome.

Your submission is subject to our Privacy Policy, which outlines how your data is handled and shared. You may request to update or delete your data at any time in accordance with that policy.
 

3. Intellectual Property

All content and materials on the Services — including trademarks, logos, text, and software — are the property of GlobalMark or our licensors. You may not copy, modify, distribute, or use any content without prior written permission, except for your personal use in connection with job search or hiring.
 

4. Candidate Submissions

By submitting a resume or application through our Services, you:

  • Grant GlobalMark a non-exclusive, worldwide, royalty-free license to use, store, and share your information with prospective employers and select third-party recruiting partners for recruitment purposes, including referrals or submittals on your behalf.

  • Affirm that your information is accurate and lawfully provided.

  • Consent to GlobalMark sharing your data with carefully selected recruiting partners where we believe it may lead to relevant job opportunities. All partners are required to handle your data in accordance with applicable privacy and data protection laws.

  • May withdraw your data or request deletion at any time, as outlined in our Privacy Policy.
     

5. Client and Partner Use

Clients and third-party recruiting partners agree to:

  • Use candidate information solely for legitimate hiring or placement purposes

  • Maintain the confidentiality of all candidate data received via GlobalMark

  • Refrain from redistributing, reselling, or scraping candidate information

 

Unauthorized use of candidate data or misuse of the Services may result in account suspension, termination, and legal liability.
 

6. Third-Party Links

The Services may contain links to third-party websites or services. These links are provided for your convenience only. We are not responsible for the content, privacy practices, or policies of any third-party site. You access them at your own risk.
 

7. Disclaimers

Our Services are provided “as is” and “as available,” without warranties of any kind. We do not guarantee:

  • Specific hiring outcomes or employment results
  • That candidate information is complete, current, or accurate
  • Uninterrupted or error-free access to the Services


To the fullest extent permitted by law, we disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infrigement.

No Guarantee of Employment
We do not represent or warrant that use of the Services will result in employment or job offers. Decisions by employers and partner firms are outside of our control.

 

8. Limitation of Liability

To the maximum extent permitted by law, GlobalMark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, business interruption, data loss, or goodwill, arising from or related to your use of the Services, even if advised of the possibility of such damages.
 

Our total aggregate liability shall not exceed one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

 

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, and applicable federal laws of the United States.
 

If you are an international user, you may also be entitled to the protections of local consumer or data protection laws where applicable.

 

10. Changes to Terms

We may update these Terms from time to time. Updates will be effective upon posting the revised Terms on our website. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe that:

  • You have violated these Terms or applicable laws
  • Your conduct may harm GlobalMark, other users, or third parties
     

You may stop using the Services at any time.


12. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved by binding arbitration conducted in Connecticut under the rules of the American Arbitration Association (AAA).

  • You waive your right to a jury trial
  • You waive participation in any class action or class-wide arbitration
  • The arbitrator’s decision will be final and binding

 

Opt-Out Clause

You may opt out of this arbitration provision by sending written notice within 30 days of accepting these Terms to:

13. Force Majeure
GlobalMark shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, outages, acts of government, war, labor disputes, or internet disruptions.
